【旧優生保護法下に行われた、強制不妊手術の裁判を応援しています】
昨年から引き続き、旧優生保護法の時代に行われた強制不妊手術が大きな問題となり、国を相手どった裁判が起こされています。
こうした動きの大きなきっかけとなった仙台裁判は判決を迎え、また6月30日には東京判決も出ました・・・が、これらの判決は、子どもが持てなくなる手術を、本人の合意なく(本人に知らされずに)、強制的に受けさせられた人や支援者たちもとうてい納得のいかない残念な結果となっています
大阪では、本日7月17日に行われた裁判が、最終的な判決が出る前の結審(意見や証拠を提出できる最後の回)だったので、応援に行ってきました。
関西には、この裁判を応援する「おおさか旧優生保護法を問うネットワーク」という、各団体を越えた支援者のつながりがあり、夢宙センターはその窓口を担っています。
コロナ禍で行われる裁判なので、法廷内の傍聴席にも人数制限がされていました。原則マスクを着用し、裁判の真っ最中に換気タイムも設けられた裁判でした。
いつもは100人以上の支援者が詰めかける裁判後の報告集会も、3密を避けるため、オンライン(オンライン会議システムZoomを利用した報告集会)でも行うこととしました
現地会場での参加者以外にも、約40名の方々がご自宅などから報告集会に参加し、みんなで原告さん方の声に耳を澄まし、裁判の説明を聞き、質問することができました。もちろん、文字通訳や手話通訳の画面もあり、情報保障もバッチリです。
命の格付けを行う優生思想、それを元に作られた差別的な法律・優生保護法。 その法律下で行われた強制不妊手術は、心と体のみならず、人生を傷つけ、いまなお人を苦しませつづけるひどい差別にほかなりません
原告の方は、「私の体を元にもどして。なぜ私の知らない間に、手術をさせられたのか。いまでも怒りでいっぱいになる。国に対して、この怒りを届けたい」「誰もが同じように家庭を築ける権利があります」「なぜ私たちがこういう思いをしなければならないのか」などあふれんばかりの痛切な心情を語られていました。
さまざまな人々の人生を台無しにした憲法違反の差別に対して、少なくとも国は謝罪と補償とで責任をとらなくてはなりません。 この判決は11月30日の裁判で行われます。

【We're supporting the forced sterilization trials that took place under the old Eugenics Protection Act.】 Forced sterilizations performed during the old Eugenics Protection Act era continued to be a major issue over the last year. Lawsuits under the State Compensation Act are being filed across the country.
The Sendai Tribunal, which was a major catalyst for these developments, was judged, and on June 30, the Tokyo court case was also judged.
But these rulings are unsatisfied with all the people. Because the surgery that made it impossible for them to have a child without their consent (without being informed) and their supporters are angry with the results
In Osaka, the trial, which took place today, July 17, was the court case before the final verdict was issued (the opinion and evidence submissions were the last chance to do so). We went to support the court hearing.
In Kansai area, there is a supporter’s network called "Network to Question the Old Eugenics Protection Act of Osaka" that support this trial. There is a connection of supporters across the board, and the CIL Muchu is the point of contact for them.
The number of people in the audience seats in the courtroom was limited because of the new coronavirus pandemics. As a rule, we should have worn masks and needed ventilation time even in the middle of the trial.
After the trial debriefing meeting, which usually attracts more than 100 supporters, was designed to avoid the 3Cs (Closed space, Crowded place and Close contact settings). We decided to hold the online meeting (using the online conference system Zoom),too.
In addition to the participants at the local site, about 40 people attended the debriefing meeting from their homes and other locations, and together we were able to listen carefully to the plaintiffs' voices, listen to lawyers' explanations of the trial, and ask questions. Of course, there are also screens for text and sign language interpreters. The information accessibility was perfect.
Eugenics philosophy is to grade life. And the Eugenics Protection Act, a discriminatory law based on that philosophy.
Forced sterilization under this law hurts not only the body and mind, but also the lives of those who are still suffering. It's nothing short of appalling discrimination down the line!
The plaintiff said, "Put my body back. Why did they make me have the surgery without informing to me? I am still filled with anger. I want to bring this anger to the state." "Everyone has the same right to have a family." "Why me? Why did they make me take surgery?" "Why do we have to suffer from this?" The plaintiff talked about the heartfelt feelings.
For the constitutional discrimination that ruined various people's lives, at least the state has to apologize and compensate for the plaintiffs as the state take their responsibility.
This judgement will be done at the trial of 30th, Nov.
